作为 HR，面对疫情时需如何应对：12 ～ 申请通行证时要填，请问 什么是 Manufacturing Licence?

1. 政府宣布在行动管控指令落实期间:

~ 获准继续营业的私人界

~ 需向国际贸易及工业部 [MITI - https://www.miti.gov.my/]申请以取得“通行证”

2. 在作出申请时，商家发现需要填写一个所谓的 Manufacturing License

3. 一些中小制造商，或许还不清楚这究竟是什么？

4. 政府在1975年5月22日，颁布了：

~ 1975年工业协调法【Industrial Co-ordination Act, 1975，简称 ICA】

5. 主要的目的是：

~ 确保国内制造业有秩序的发展与成长。

6. ICA 规定，凡从事制造业的公司:

~ 其股东资金为马币250万令吉（RM250万）或以上，或

~ 其全职受薪雇员为75名或更多者，

~ 都须向国际贸易及工业部（简称贸工部，简称 MITI）申请工业执照 【Manufacturing License】

7. MIDA 是贸工部管辖下，为促进与协调马来西亚境内工业发展的机构。

8. “活动”是指：

~ 为了使用、销售、运输、交送或处置的目的，而对任何物品或材料进行制作、改变、混合、装饰、润饰或以其他方法处理或改装的活动，

~ 这包括零件的组装及船舶的修理，但不包括一般与零售或批发业相关的活动。

[“manufacturing activity” with its grammatical variations and
cognate expressions means the making, altering, blending,
ornamenting, finishing or otherwise treating or adapting any article or substance with a view to its use, sale, transport, delivery or disposal

and includes the assembly of parts and ship repairing

but shall not include any activity normally associated with retail or wholesale trade]

9. 但是，有些工业活动被豁免。豁免的包括：

~ 将油棕鲜果串榨取棕油

~各种类型的天然橡胶生产与加工，包括：乳胶、脱脂、
板材、废料、技术规范的橡胶、非标准和改良橡胶或任何其他以专利或技术规定的程序所制备未硫化形式的天然橡胶，；和

~ 水稻磨成米

【However, certain activities that are exempted from ICA. These are：

~ milling of oil palm fresh fruits into crude palm oil;

~ the production and processing of raw natural rubber of all types including latex, skim, sheets, scrap, technically-specified rubbers, non-standard and modified rubber or any other unvulcanised form of natural rubber prepared by any patented or technically specified procedure; and

~ the milling of paddy into rice.】

10. “股东资金” 是指:

~ 公司实际资本、储备金、股份溢价帐余额，以及累计损益总和。

【Shareholders’ funds” are the aggregate amount of a company’s paid-up capital, reserves, balance of share premium account and balance of profit and loss appropriation account;】

11. “全职受薪雇员”是指：

在公司内一年12个月，每个月至少20天，每天正常工作至少6小时，并有领取薪金的所有员工

【Full-time paid employees” refers to all the persons normally working in the establishment for at least six hours a day and at least 20 days a month for 12 months during the year and who receive a salary】

12. 申请工业执照 【Manufacturing License】是不用钱的，也不需要 Renew

13. 很简单，那些：

~ 股东资金 < RM 250万；或

~ 其全职受薪雇员 < 75名

~ 通过 ICA 10 form 提出豁免申请

~ 过后将收到 MIDA 发出的豁免信 【Surat Pengesahan Untuk Syarikat Perkilangan Dikecuilikan Daripada Lesen Pengilangan Di Bawah Akta Penyelarasan Perindustrian 1975 (Akta 156)]

~ 这这是一封信，地位不等同 manufacturing licence

14. 一旦制造商的：

~ 股东资金 > RM250m；或

~ 全职受薪雇员 > 75

~ 就需要去申请 manufacturing licence
