我是打工皇帝系列 - 65 ~ 关于年假,不得不知。。

【Something about Annual Leave’s entitlement】

S60E. (1) ~ An employee shall be entitled to paid annual leave of—

(a) eight days ”for every twelve months of continuous service“
with the same employer if he has been employed by that
employer for a period of less than two years;

因此,假设一个员工在2018年1月1日加入一家公司,for every twelve months of continuous service 的意思是说,他必须要在该公司连续服务12个月,才享有8天的 Annual Leave。

也就是说,他要在 2019年1月1日,才正式享有这8天的 Annual Leave。

特殊的情况是:

1. 他中途辞职,那么就会 Pro Rate;又或者是

2. 公司的 policy 是根据 Pro Rate 给予【也就是不需要等到 2019年1月1日。假设员工做了半年,就享有4天】

3. 公司允许 advance annual leave

S 60E. (2) - The employer shall grant and the employee shall take such leave not later than twelve months after the end of every twelve months continuous service and any employee who fails to take such leave at the end of such period shall thereupon cease to be entitled thereto:

Provided that an employee shall be entitled to payment in lieu of such annual leave if, at the request of his employer, he agrees in writing not to avail himself of any or all of his annual leave entitlement.

这个的意思是说,1.1.2018 – 31.12.2018 这段时间的8天 Annual Leave,在 2019年1月1日正式享有后,他必须要在2019年12月31日或之前,clear 完他这8天的 Annual Leave,否则就会 Burn 掉,除非:

在老板的要求下,员工书信同意,将之变成 $$$。

特殊情况:

有些公司会允许 Carry Forward,这都是公司 Policy。

员工出国回不来, 打电话回来跟公司请假,公司可以不接受吗?公司可以炒她吗?

指控员工无故缺席 + 习惯迟到 + 吃 Lunch 吃久久,解雇无理,赔偿 RM 41,600

9  做了1年零4天 薪水RM2,200,无理被解雇,老板总共赔 RM40,920
