(i) 索賠人2 【Claimant - 员工】 - Leong Chee Kong [简称 - LCK]；

(iii) 辩方 【The Company - 雇主】 - Novartis Corporation (Malaysia) Sdn Bhd 【简称 - 公司】；

(iv) 辩方证人：

- COW 1 ~ Mr Tan Kong Hun，公司法律及遵循部主管【Head of Legal & Compliance of the company】

- COW 2 ～ Mr Tang Hang Cheng，公司 Citibank 的物流计划经理/公司的安全经理 【Logistics Planning Manager/ company's Security Manager for CitiDirect】

- COW 3 ～ Ms Michaela Christiane Dinbocck，公司马来西亚和文莱首席经理及区域总裁 【General Manager and Country President for Malaysia and Bruneit】

1。 在2013年10月18日至2013年11月21日期间，究竟是谁在进行相关欺诈性交易【fraudulent transactions】？

2。 这个人，其实就是 ---

3。 公司的财务报告及会计部门 【 Financial Reporting and Accounting Department, (FRA)】的一名叫做 Angie Ng 的 Accounts Executive。

4。 Angie Ng 在2013年11月24日做了一份 Police Report 。她

5。 她在 Police Report 中承认，在2013年10月18日至2013年11月22日期间，欺诈性盗取公司共计416万令吉【公司所作出的总结是707万令吉；但是裁决没做为什么会有差异的解释】

6。 公司第五证人 - COW 5【也就是 Angie Ng 的上司】， 在 Angie Ng 向她承认挪用公款435万令吉【够力，到底是435万令吉，还是416万令吉，又或者是707万令。不重要啦，总之就是几百万令吉】后，对这事件进行了初步调查【conducted preliminary investigations】。

7。 COW 5 在她的报告中披露，Angie Ng 所有欺诈性交易都是使用手动输入法【used the manual input method for all the fraudulent transaction】。

8。 她手动输入了所有转账资料，然后提交给“批准人”【Approver】，分别是 LL 及 LCK） 批准。

9。COW 5 也说，她怀疑 Angie Ng 欺骗 LCK，以获得花旗银行Token 和密码 【Citibank safeword token and password】

10。 COW 5也披露，Angie Ng 她：-

- 修改 bank reconciliation 以便差异没有显示在账面上， 因此 COW 5 不会知道有出入【manipulated the accounts that monthly bank reconciliation did not show a difference and she (COW5) will not be notified of any discrepancies】

- 抵消两个 Accounting Entires，以便银行账户正确反映 Balance 【Angie Ng had reversed 2 accounting entries to reflect the correct outstanding balance】

11。 公司第三证人 COW 3 作证时表明，公司调查小组的结论 -- 是 Angie Ng 涉及欺诈性交易 【Angie Ng who made the fraudulent transactions】

12。 公司第四证人 COW 4 作证时表明，承认承认 Angie Ng 用 LL 及 LCK 的 Token，进行欺诈性盗款【咦，奇怪了，LL 的 Token 不是坏了吗？】

13。 根据证据及资料显示，法庭发现肇事者【perpetrator】就是 - Angie Ng。

14。对此，公司无异议。

15。 但是，公司认为 LL 及 LCK 失职，没有好好保管本身的 Token，才会让 Angie Ng 有机可乘。

16。 公司也认为，居然 Angie Ng 是用着 LL 及 LCK 的 Token 做 Approval，LL 及 LCK 是否有将密码【Password 】透露给 Angie Ng?

- (a) Whether Lee Lily Failed To Keep Safeword Token To Herself And Under Her Custody And Care?

(b) Whether The 2nd Claimant Failed To Keep His ‘Safeword’ Token To Himself And Under His Custody And Care?

- (c) Whether The 1st Claimant Lee Lily Failed To Keep Her Username And Password At All Times Confidential?

- (d) Whether Lee Lily Failed To Follow Up On The Safeword Token?

- (e) Whether The 2nd Claimant Failed To Keep His Username And Password At All Times Confidential?

- (L) The 2nd Claimant’s Purported Breach of Confidentiality In Discussing The Business Practice Office (BPO) Investigation With Lily Lee

- (M) Whether Lee Lily Was In Breach Of The Confidentiality Clause When She Discussed The BPO Report With Lee Chee Kong?

- (N) Did The 1st Claimant And 2nd Claimant’s Behaviour Fall Below The Reasonable Standard?
