LLP/有限责任合伙公司 6: LLP 需要报 Tax 吗?

1. LLP - 在2012年有限责任合伙企公司法令《Limited Liability Partnerships Act 2012》下注册的注册的公司

2.法定人士包括：公司、团体、LLP及个人独资公司

税务的处理方式 【Tax Treatment 】

3. 大家应该知道，Partnership:

～ 只需要报 Form P，

～ 然后把 CP 30 交一份给股东去报 Tax

4. Partnership 本身是没有交任何 Tax 的，也就是说：

～ Partnership 本身不会中 Tax 的；

～ 如果有赚钱，Tax 是由股东各别按比例去报【根据 CP 30】

～ 即使股东有领薪水，这个薪水也是填入 CP 30

～ Partnership 如果亏损的话，相关的亏损由股东按比例承担

5. 至于Sdn Bhd，它是一个独立的个体。因此：

～ Sdn Bhd 自己需要报 Tax；

～ Director 如果有领薪水的话，这薪水是从公司 Profit 扣除出来

～ Director 的薪水需要缴付 PCB，Director 拿 EA Form 去报 Tax

～ Sdn Bhd 如果亏损的话，相关的亏损会带下去下一年，拿来抵消下一年的 Profit

6. LLP 税务的处理方式，偏向于 Sdn Bhd

7. LLP 本身属于一个各别个体【Separate Entity】，因此 LLP 需要为本身的 Profit 缴付 Tax

8. 虽然如此，但是 Sdn Bhd 享有的一些税务优惠 【Tax Incentive】，LLP 则无法享有，比如：

～ Pioneer Status (PS)

～ Investment Tax Allowance (ITA)

~ Reinvestment Allowance (RA)

~ Promotion of Export
