关于产假产薪：3 ～ 产假不是必然的

【Maternity Leave is only given in respect of a pregnancy carried to a term of 22 weeks (East Malaysia – 28 weeks)】

1. 职业女性：

～ 每一次的分娩，

～ 均享有60天产假的权利

The right to the 60 day maternity leave is provided for 'each confinement

2. 分娩的定义，

～ 至少怀孕22周后；

～ 无论孩子存活或者死亡；

A 'confinement' is defined as 'parturition resulting after at least 22 weeks of pregnancy in the issue of a child or children whether dead
or alive

3. 因此，有着怀孕22周的“限制”

4. 2012年的修订，政府把原本的28周修改成22 周，大概是5个半月

5. 不过东马，即：沙巴与砂拉越依然维持在28周【不过有着手在修订，以便于西马统一】

6. 在这项（4）修订后，早产的职业女性，也享有产假

7. 但是基于有着“22周”的限制，在怀胎22周前：

～ 生产；

～ 流产；或

～ 其他并发症

就会被排除在外

8. 然而，法律终归法律，相信雇主一般都会酌情处理
