3. 接下来，很多人的问题是：

～ 薪水是指什么？

～ 薪水 RM1,000，津贴 RM200，可以吗？

2011年国家工资协商委员会法令

《National Wages Consultative Council Act 2011 》

4. 这在2011年9月23日生效的法令，主要的目的是：

～ 建立国家工资协商委员会

～ 负责进行研究关于最低工资的所有事宜。

～ to establish a National Wages Consultative Council

～ with the responsibility to conduct studies on all matters concerning minimum wages.

～ This Act came into operation on 23rd September 2011.

2020年最低薪金指令 《Minimum Wages Order 2020》

5. 引以 ～ 2011年国家工资协商委员会法令第23条文：

～ 对我国56主要城市的最低薪金

～ 上调至 RM1,200

6. 因此，对于 Wages/Salary 的定义，我们需要参考回 2011年国家工资协商委员会法令 《National Wages Consultative Council Act 2011 》，薪水的定义：

～ 西马 - 参考1955年劳工法

～ 沙巴 - 参考沙巴劳工法

～ 砂拉越 - 参考砂拉越劳工法

7. 有鉴于此，大家需要去看劳工法了

1955年劳工法令 《Employment Act 1955》

8. 薪水的定义：

～ 支付给员工的基本工资和所有其他跟工作有关系的现金付款

～ basic wages and all other payments in cash payable to an employee for work done

9. 但是薪水的定义不包括 【but does not include—】：

(a) 任何房屋住宿的价值或任何食物、燃料、电或水或医疗服务的供应，或任何认可的便利设施或服务的供应

[value of any house accommodation or the supply of any food, fuel, light or water or medical attendance, or of any approved amenity or approved service]

(b) 雇主自行支付的任何退休金、公积金【EPF】、退休金
年金计划；裁员、解雇或退休计划等等

【any contribution paid by the employer on his own account to any pension fund, provident fund, superannuation scheme, retrenchment, termination, lay-off or retirement scheme, thrift scheme or any other fund or scheme established for the benefit or welfare of the employee】

(c) 任何的交通津贴

【any travelling allowance or the value of any traveling
concession】

(d) 支付给员工的费用开支【就是大家熟悉的 Disbursement】

【any sum payable to the employee to defray special expenses entailed on him by the nature of his employment】

(e) 退休金【Gratuity】

(f) 花红 【Bonus】

10. 这当中，比较 confusing 的是 (c) - any travelling allowance。纯粹按照法律的字眼，交通津贴不算是 Wages 的定义内

12. 处理起来，需要谨慎，个人认为：

～ 如果在 RM200 Allowance， Payslip 上写 - Phone Allowance，那就。。。。还好

～ 如果在 RM200 Allowance， Payslip 上写 - Allowance，那就。。。。有点含糊，当含糊出现是，一般都是老板/公司吃亏

～ 如果在 RM200 Allowance， Payslip 上写 - Travelling Allowance，那就。。。。有点糟糕，因为1955年劳工法基本上已经阐明，交通津贴不在薪水的定义内

13. Petrol Allowance 跟 Travelling Allowance 会有分别吗？
单纯从法律字眼看，是有分别的。

我不晓得相关部门【劳工部、EPF、SOCSO 等等】的官员会如何诠释
