特讯 55：2016年公司法令下关于实质受益人的条文 [Relevant provisions in the Companies Act 2016 on beneficial owners]

1. 除了《法人的实质受益人报告框架指南》外，我们也应该看看2016年公司法令 

2. 2016年公司法令将“实质受益人”这个术语定义为： 

～ 公司股份的最终拥有人，但是却不包括任何描述下的代理人。 

～ ultimate owner of the shares of a company and does not include a nominee of any description 

3. 简单来说，所谓的“实质受益人”，就是一个最终拥有或控制一个实体或安排的自然人。 

～ Beneficial owners are natural persons who ultimately own or control an entity or arrangement. 

4. 参考第二张图，林北是一个自然人 

5. 林北是 Lim Bei Construction Sdn Bhd 的实质受益人 【Beneficial Owners [BO] 】- 直接拥有人 

6. 同时，林北也是 Lim Bei Corporation Sdn Bhd 的实质受益人 【Beneficial Owners [BO] 】- 间接拥有人
