“就业保险计划” 【EIS，Employment Insurance System】

1. 2017年“就业保险计划”（E I S）法案通过后：

～ 强制性每位打工一族必须投保，

～ 保费由雇主和员工同等承担。

2. 在2017年“就业保险计划”法令 《Employment Insurance System Act》下，符合以下这些条件的打工一族，都在投报范围内：

～ 马来西亚公民/永久居民

～ 年龄介于18-60岁*

～ 在私人界工作**

～ 受聘于雇佣合约

～Malaysian citizens / permanent residents

～Aged 18-60*

～Working in the private sector**

～Employed based on a contract of service

例外 Important exception

🙋‍♂️ *57岁及以上的打工一族，如果在之前从来没有缴纳过保费，将不受《 就业保险计划法令》的保护，当然也就不需要缴纳 EIS

🙋‍♂️ **《 就业保险计划法令》不涵盖家庭工人、自雇人士、公务人员以及在地方政府和法定机构工作的人。

🙋‍♂️ * Workers aged 57 and above who have never paid contributions before that age are NOT covered by the EIS Act and are NOT required to contribute

🙋‍♂️ ** The EIS Act does NOT cover domestic workers, the self-employed, civil servants, and workers in local authorities and statutory bodies.

3. 《 就业保险计划》提供两个好处，即：现金津贴及找工援助

【The Employment Insurance System Office offers two kinds of benefits, namely monetary benefits and job search assistance】

4. 法令阐明，投保的打工一族如果失业了，可享有5种现金津贴，即：

～ 求职津贴 Job Search Allowance (JSA)

～ 收入减少津贴 Reduced Income Allowance (RIA)

～ 培训费用 Training Fee (TF)

～ 培训津贴 Training Allowance (TA)，以及

～ 提早再就业津贴 Early Re-Employment Allowance (ERA)

10. 《 就业保险计划法令》第30条文阐明，失业的定义是：

～ 投保员工的雇佣合约被终止

11. 但是，失业的定义并不包括🙅：

～ 投保员工自愿辞职 Voluntary Resignation

～ 合约届满 Expiry of Contract

～ 雇主和雇员在毫无条件下同意终止合约 Termination by Mutual Consent

～ 按合约完成工作 Completion of Contract

～ 退休 Retirement，以及

～ 行为不检被开除的情况 Misconduct

13. 失业的定义包括：

a. 因天灾而关闭公司 Closure of the company due to natural disasters

b. 公司破产或关闭 Bankruptcy or closure of the company

c, 有生命危险的威胁下的离职 Resignation after being ordered to perform dangerous duties that are not within the job scope

d. 一般的裁员或遣散 Normal retrenchment and redundancy

e. 自愿离职方案 VSS/MSS (Voluntary/Mutual Separation Scheme)

f. 推定辞职 Constructive dismissal

g. 性骚乱下的辞职 Resignation due to sexual harassment or threats made in the workplace
