老师，我找你：1 - 算 OT 时要不要包括 Allowance?

~ 老师您好，一月份我公司被劳工部突查。

~ 因为我有借钱给工人扣在工钱，然后appointment letter没有注明OT rate，被令上法庭罚款2千。

~ 2月我又收到他们来信讲我的allowance 没算OT又要罚款我 RM1500。。

~ 他讲是seksyen 99A Akta kerja 1955, 我上网查了查，这个Akta 是关于pekerja asing的，但我的是本地员工，

~ 我也翻了翻关于allowance 的相关资料。。。也找不到要算OT,

~ 我想请问老师有这方面的资料可以分享让我参考吗?

～ 任何商家如果触犯了

～ 一旦被提控并被定罪，罚款不超过 RM10千令吉

2. 1955年劳工法令第 60A 条文：

～ 这个条文讲的是 - 工作时间【Hours of work】

3. 第 60A(3)(a) 条文阐明：

～ 任何超过正常工作时间的工作，都属于加班

～ 每个小时，将享有不少于1.5倍的时薪

【not less than one and half times his hourly rate of pay】

～ 就是说，1.5倍的时薪是最低的要求

～ 在计算 ORP 时，工资是按照1955年劳工法令第2条文下所定义的

～ 但是不包括 Approved Incentive Scheme、休息日及公共假期工作补贴

～ 工资包括底薪，加上

～ 其他所有因完成工作而必须作出的现金支付款项

10. 工资在第 2 条文的定义下，并不包括 6 样东西，其中包括

～ 花红【Bonus】

～ 遣散费【Gratuity】

～ 交通津贴【Travelling allowance】

～ 雇主所支付的 EPF【any contribution paid by the employer on his own account to any pension fund, provident fund】

～ 房屋补贴【the value of any house accommodation】

那到底在算 OT 时，要不要包括 Allowance？

11. 举例，老马：

～ 1月的薪：RM1,300

～ 电话津贴：RM208

～ 1月份拿到的花红：RM2,600

工作时间：一天8小时【扣掉午餐】

12. 计算 ORP：

～ (1,300 + 208)/26

= RM58

13. 计算 HRP：

～ RM58/8

= RM 7.25

解释 【Explanation】

14. 从上面的例子，可以看到：

～ 在计算 OT 时，我们需要用 HRP * OT 的小时

～ 然后 HRP 是用 ORP 算出来的

～ 然后呢， ORP 是按照 1955年劳工法令第2条文下所定义的工资【wages】算出来的

15. 1955年劳工法令第2条文下对于工资的定义，exclude 了6样东西，其中一样是大家所熟悉的：

～ 交通津贴【Travelling allowance】

16. 这位学生，没有说她所支付的 Allowance 是什么类型的 Allowance。

17. 但是，只要不是交通津贴或房屋补贴，所有的 Allowance 在计算 OT 时，都必需要包括在内

18. 但是但是，你千万不要为了省 OT，把部分薪水刻意讲成是 Travelling Allowance:

～ 有事情时，在法庭上

～ substance 还是 over form
