1. 公司是旅行社，最近有导游刚刚从中国回来

2. 我做 admin 的，后天我就要上班了。我有妄想症，我总在是想，一上班我就会被感染

3. 公司没有发布任何防范措施

4. 我知道被感染后死亡的机率是很小，但是我总是担心会死去，因为我家还有两老要养

5. 我问医生，医生说：非常理解我们或多或少都会有这样的担忧

6. 在这非常的时期，有时候，想象当中的恐惧，比真实情况更加令人恐惧

1955年劳工法令【Employment Act 1955】

8. 如果公司真的有武汉肺炎病毒爆发：

～ 我可以合法地拒绝工作【 lawfully refuse】吗？

～ 我想不要继续做工了

～ 但是我的 Notice 是 2 个月，我可以丢信然后马上走人吗？

～ 我会被公司告的吗？

9. 坦白说，这要视情况；但是并非不可能

10. 劳工法第14条文主要阐明：雇佣合约【Employment Contract】出于特殊原因而终止
【Termination of contract for special reasons】

11. 第14（3）阐明：员工可以在没有给公司 Notice 的情况下，可以终止雇佣合约，如果：

～ 他或他的家属即时遭受到暴力或疾病威胁的危险

An employee may terminate his contract of service with his employer without notice where he or his dependants are immediately threatened by danger to the person by violence or disease

~ 而雇用合约没有说他需要这样做

such as such employee did not by his contract of service undertake to run.

12. 在工业法庭上，有没有类似的 Case ？

13. 我发现，工业法庭的主席在审理时，一般都会引以这个案件～ Bouzourou v. The Ottoman Bank and Donovan v. Invicta Airways Ltd：

～ 如果把员工从一个省转移到另一省，

～ 并让他立即面临暴力或疾病威胁的危险

～ 他可以视为自己被解雇

【to regard himself as being dismissed if his transfer from one province to another province rendered him exposed to an immediately threatening danger of violence or disease to his person】

14. 当然工业法庭在诸多案件，一再强调：

～ 我们必须看违约的根源，它必需要非常严重。=

～ 严重到，员工无法指望继续履行其合约

The paramount consideration is the requirement that the breach must be so serious which goes to the root of the contract and the employee cannot be expected to continue with the contractual arrangement

～ 有些公司赢，

～ 有些案件员工赢。
