今日一案：3 (上) ～ 读这么多书，却没工给我做，告你！

案件：Petrolium Petronas v Nik Ramli Nik Hassan

主因：读太多书

简要事实 【Facts】

1。Nik 于1977年获得地质学硕士学位。

2。他在1977年12月16日开始受聘为地质学家

3。他于1978年12月16日被公司 confirm

4。1979年至1983年，他担任过多个职位，最后担任地质项目科主管

5。1983年，他获得了奖学金，在英国牛津大学修博士学位。

6。该课程于1986年9月完成后，Nik 返回马来西亚，重新回到公司上班

7。公司把他安置在实验室服务部门

8。在向实验室服务部门经理报到时，Nik声称公司没有给他任何职位或 job description

9。由于对公司这种安排感到不满意，Nik 向他上司查询

10。上司跟他说：

～ 你现有的学历【PhD】，现在的部门没有任何适合你的工作给你

～ 公司即将成立 PRI 【Petronas Research Institute】，到时候“可能”就会有工作安排给你

～ 在 PRI 还没有成立前，你还是继续under

11。 1987年年中，PRI 终算设立了，Nik 被调派去那边，工作还是“地质学家”

～ 也就是说，职位还是跟以前一样

12。Nik 当这是降级【Down grade】，因为读了那么多书，他此时的职位跟1978年进工没有分别

13。1988年11月30日，他写了一封投诉信，要求 transfer到其他部门

14。但是公司一点回应也没有

《意思是：采你都傻》

15。Nik boi tahan 了，1998年12月12日，写了一封提醒信给上司并cc 给副总裁

- With reference to my memo dated 30th November 1988 on the above, I would appreciate if action on the memo could be carried out on or before the 16th of December 1988 following which I may have to consider other options.

16。这封信看起来像是向公司发出最后的通牒

17。由于公司继续充耳不闻， Nik 在1988年12月20日，再给公司写信，大意【原文看英文】：

- 我被你们冷藏了2年！

- 居然你们充耳不闻

- 我没有选择，只好辞职

- 是你们逼我的 【Constructive Dismissal】

- I refer to my letter of 12th December 1988 on the question of employment with the Company to which I have yet to get a reply.

- I have been patient for almost two years while I was under 'cold storage'.

- It has now become clear to me that the Company has evinced an intention not to be bound by the terms of my employment contract and the scholarship agreement dated 8th October 1983.

- Under the circumstances, I have no alternative but to consider myself dismissed with effect from 20th December 1988.

18。然后 Nik 就不再上班

19。1988年12月23日，公司HR 经理叫他回公司继续工作

20。但是，满肚子受委屈的 Nik 不理会，视自己被解雇

21。随后就到工业法庭，去举报遭受公司的逼害而被逼辞职【这种辞职叫做 - 推定辞职 Constructive Dismissal】

22。小时候，不读书妈妈会骂

23。长大后拼命读书，有时候又发现读太多了

24。Nik 就是一个例子，读那么多书，却大材小用

25。最终发现，用了金钱岁月苦读回来的博士，并且没有让工作职位提升

26。🈵️肚子牢骚、🈵️肚子怨气、🈵️肚子委屈的离开

27。Nik 告公司，最终谁会赢？

28。我先透露一点点天机，这场官司真的是惊天动地、波涛汹涌：

- 从 Industrial Court 打到 High Court

- 再从 High Court 打到 Court of Appeal

- 然后从 Court Of Appeal 打到 Federal Court
