1. 关于试用期，企业间流传许多以讹传讹的错误观念，很多公司以为试用期是免死金牌：
👉 只要员工尚在在试用期；

👉 不用理由就可以开除人

2. 在此系列的第一篇文章我提到，在马来西亚、或沙巴、或砂拉越《劳工法》中，并没有所谓的「试用期」[Probation Period]。

3. 试用期时，员工

❎ 无论是工作能力不足，或是

❎ 与公司文化不符；又或者是

❎ 工作态度不佳；甚至是

❎ 不当行为，违反了公司规定

👉 你都不应该随意开除员工

4. 一般上，最常见的是，试用期发现员工工作能力不足，又或者是行为不当

5. 如果是员工工作能力不足：

✅ 善尽记录的责任，

✅ 在试用期间定期考核该名员工的表现，

✅ 最好还能面对面与他检讨表现，给予改正及进步的时间。

6. HR 或老板可以在新人进来的第一天：

✅ 与他设立明确的考核方式，并说好试用期的 KPI，好比业绩目标是多少、应该完成哪些任务，

7. 在 Khaliah Abbas v. Pesaka Capital Corp. Sdn. Bhd. (1997) 3 CLJ 827 这起案件，上诉庭 [Court of Appeal] 如此裁决：
“It is our view that an employee on probation enjoys the same rights as a permanent or confirmed employee and his or her services cannot be terminated without just cause or excuse.

The requirement of bona fide is essential in the dismissal of an employee on probation but if the dismissal or termination is found to be a colourable exercise of the power to dismiss or as a result of discrimination or unfair labour practice, the Industrial Court has the jurisdiction to interfere and to set aside such dismissal.

In the present case we find that the Industrial Court made a finding of fact that the dismissal of the appellant was without just cause or excuse.”

8. 意思就是说，即使试用期的员工迟到早退、违反公司纪律或不当行为；公司若要解雇的话，还是需要合情合理的理由，并遵循程序
