#如何像大家姐一样思考：41 - 每个月要缴纳的 SOCSO 是根据什么计算出来的? OT, Commission, Incentive 都要?

1. 经常都会有人问我：老师，这个要给 SOCSO 吗？那个要给 SOCSO 吗？

2. 其实，要不要给，绝对不是老板，又或者我说了算，当然，也不会是 Officer 说了算

3. 究竟什么薪酬要给 SOCSO，其实还是要参考我们的雇员社会保险法令 [Employees’ Social Security Act 1969]

4. 根据 1969 年雇员社会保险法令 (Employees' Social Security Act 1969 (Act 4)) 第 3 附表 [third schedule]

👉 第一类和第二类的雇员社会保险，应依据一个月的“工资”来计算

👉 Contributions of the First and Second categories shall be calculated with reference to monthly wages 

5. 这里所说的一个月的“工资”，指的是一个月所获取的“薪水”，无论你的薪水是根据月薪、周薪、日薪、时薪、还是计件 [Piecemeal] 计算

6. 那么，究竟什么是“工资” [Wages] 呢？

7. 第 2 条文阐明：

👉 “工资”是指雇主应向雇员支付的所有酬金，包括：休假、假期、加班费和假期加班有关的任何报酬，但不包括：。。。

👉 “wages” means all remuneration payable in money by an employer to an employee including any payment in respect of leave, holidays, overtime, and extra work on holidays but does not include ...

8. 坦白说，要去分什么薪酬需要缴纳，什么不需要，是有点困难的。

9. 有没有简单一点的方法？

10. 其实是有的。

11. 居然法令说 - 所有酬金：

👉 那么首先，我们就假设全部薪酬都需要；

👉 然后，我们去看有什么法令说说是不包括的，

👉 总薪酬，扣掉那些不包括的，剩下的，就拿去计算 SOCSO 吧

12. 不包括的是以下这些，也就只有以下这些而已：

(a) any contribution payable by the principal employer or the immediate employer to any pension fund or provident fund, or under this Act;

(b) any travelling allowance or the value of any travelling concession;

(c) any sum paid to an employee to defray special expenses incurred as a result of his employment;

(d) any gratuity payable on discharge or retirement;

(e) annual bonus;

(f) any other remuneration as may be prescribed.

13. 简单来说，不包括的有：

👉 任何退休金或公积金的缴纳

👉 交通津贴

👉 任何的带付费 [员工先付，过后向公司 Claim 回的费用]

👉 在离职或退休时，所获得的恩俸金

👉 花红

👉 任何其他被 [部长或法令] 规定的薪酬

14. 或者我再简单的说 - 没有在上述（13），都在 SOCSO 范围内

15. 因此，总结：OT, Commission, Incentive，甚至是 Service Charge，全部都是需要拿来计算 SOCSO 的
