如何像大家姐一样思考:74 - Dismissing Employees In Malaysia [在马来西亚,关于员工解雇]


1. You may have read lately about Gagger, the CEO of the online mortgage firm BETTER.COM in the United States, who remarked during a meeting:

👉 "If you are on this conference call, you are one of the unlucky members who has been dismissed, and your job is now terminated immediately."

👉 900 people were sacked in one fell swoop with the use of a ZOOM video conference.

👉 This amounted to 9 percent of the company's total workforce.

👉 As a result, the employees who were abruptly terminated were speechless!

😨 The irony is compounded by the fact that Forbes magazine just ranked it (BETTER.COM) one of the greatest companies to work for, yet the termination was so "brutal" that it garnered widespread public attention and criticism.😨

2. Redundancies, layoffs, and dismissals continue to occur as a result of the pandemic, which has resulted in the closure and downsizing of several domestic and international companies. Employees' legal rights must be better understood in light of this, and it is imperative that they do so. Only by being aware of this can individuals avoid having wrongfully dismissals happen to them.

3. Generally speaking, Malaysia's law governing the dismissal of employees (as well as Malaysian labour law in general) is predicated on the principle of fairness and is hence a generally well-balanced legal framework.

4. In Malaysia, the Employment Act 1955 and the Industrial Relations Act 1967 are the primary statutes that govern relations between employers and their employees.

5. Malaysian employment law protects all employees from being dismissed without reason. As a result, an employer may not dismiss an employee only for the sake of convenience by using the termination clause in an employment contract.

6. According to Section 20(1) of the Industrial Relations Act 1967, an employee can only be dismissed if there is a justifiable reason or explanation (just cause or excuse) for doing so.

7. Therefore, valid and substantial [reasonable] reasons, as well as fair procedures, are prerequisites for a lawful dismissal.

2. 因为疫情的关系,导致许多国内和国外的公司纷纷关闭和瘦身,因此遣散、裁员和解雇的情况持续出现。有鉴于此,对雇员来说,深入了解他们的法律权益就显然变得更加重要了。也唯有在具有这方面的知识下,他们才能避开不合情合理的解雇发生在自己的身上。

3. 一般来说,马来西亚关于解雇员工(以及马来西亚一般的劳工法)的法律,是以公平原则为基础,因此普遍上属于一个平衡的法律框架。

4. 在马来西亚,雇主和雇员之间的事项,主要是由《1955年劳工法令》和《1967年工业关系法令》管辖

5. 马来西亚的劳工法保护所有雇员免遭不合情合理的解雇。

👉 因此,雇主不能仅仅为了方便,而利用雇佣合约中的终止条款 [termination clause] 而随意解雇雇员。

6. 根据《1967年工业关系法令》第20(1)条,雇主只有在具有正当理由或解释(just cause or excuse)的情况下,才能解雇雇员。

7. 因此,有效和实质性 [合情合理] 的理由,以及公平的程序,都是合法解雇的先决条件。
