老师，我找你 - 6 ：31/8 是员工休息日又是假期，但是要他回来上班，要怎么算呢？

Ngan Ngan 问：

请问31/8 是员工休息日又是假期，但是要他回来上班，要怎么算呢？

1. 马来西亚有三个劳工法：

～ 1955年劳工法令，适用于西马及纳闽

～ 1950年沙巴劳工法，适用于沙巴

～ 1952年砂拉越劳工法，适用于砂拉越

2. 员工如果在这三个劳工法的保障范围内，就能享有法令所规定的基本权利，比如：休息日、公共假期

3. 这三个劳工法都规定：

～ 8月31日的国庆日是“强制性的公共假期”；

～每个员工每个星期享有最少一天的休息日

4. 所谓“强制性的公共假期”的意思，就是说：

～雇主一定要放假；

～雇主是不能把8月31日的假期，拿去替代【Replace】其他天；

~ 当天万一需要员工回来做工的话，需要计算 Public Holiday Pay。

5. 当然，劳工法也规定，如果公共假期是落在休息日【Rest Day】，公司需要在第二天补回【也就是在隔天让员工放假】

6. Ngan Ngan 的情况是：

a) ～ 8月31日当天是员工的休息日【Rest Day】

b) ～碰巧又是国庆日，是一个“强制性公共假期”

c) ～又碰巧需要员工回来上班

d) ～怎么算薪水？

7. 我们一样一样看，先看 6 (a) & 6 (b)，有鉴于公共假期落在休息日，因此公司需要补9月1日给员工【当公共假期】。

8. 因此：

～国庆日的公共假期，被补去9月1日了；

～ 8月31日当天，依然是员工的休息日【因为员工每星期需要享有最少一天的休息日】

9. 接下来，我们看 6 (c) & 6 (d)：

～假设8月31日当天员工需要回来做工，必须计算休息日【Work on Rest Day Pay】的工钱

老头子讲Tax ~ 40: 听说最近 Income Tax 到处查/捉人

1. 确实！最近最勤劳的部门，除了卫生部外，应该就是 Income Tax 了！！

2. 自从政府宣布5月4日，让大部分商家复工后，Income Tax 就非常积极的 - 复工、做工

3. 如果懂经济原理的话，不难理解

4. 政府在 MCO 期间，派了那么多钱

5. 有没有人想过，这些钱哪里来的？

6. 一般上，三种途径：

～要嘛印【钱】

～要嘛借【钱】

～再不然就是往税收下手【查、捉、挖】

7. 最近有一位朋友致电给我，问我几个问题：

～在外国做工赚到的钱，要不要中 Tax 吗？

～在外国赚到的钱，拿回来马来西亚要不要中 Tax?

~ Dividend Income 是不是不用报 Tax 的？

8. 他这么一问，我就劈头问：你是不是中 Income Tax Check？

9. 他笑笑说：是咯

10. 这位朋友平时的收入，报不多。但是却有着蛮多的物业

11. 这一次，Income Tax 开门见山的问：你哪来这么多钱买这么多物业？请你解释一下

12. 一些商家，平时都不想，或不愿意报 Tax，当被 Income Tax 追查时，才慌张

13. 很多人用的招术是：

～钱是在外国赚到的

～钱是爸爸给的

～钱是 Dividend 来的，所以过去没报出来

～钱是我中马票、中 Toto 来的

14. 无论你怎样说都好，最终你得拿出证据给 Income Tax Officer 看啊

15. 我告诉他：

～根据 Sch 6 Para 28，外国赚到的钱，拿回来马来西亚是豁免【Tax Exemption】报 Tax 的

～ 2013年，马来西亚变成 Single Tier System 后，股息也豁免报 Tax 的

16. 我也告诉他，有一个东西叫：

～大数据【Big Data】

～ AEOI
